Ohiowa family to serve sentences
The wife of an Ohiowa man and the couple’s daughter will now join their husband/dad in the Nebraska Department of Corrections’ system.
Shane M. Kues, also known as Shane Marie Buster, 30, of Lincoln and Tamara S. Lee, 54, of Ohiowa were sentenced to prison terms late last month in recent action in the Fillmore County District Court.
Lyle S. Lee, 55, of Ohiowa received a sentence of 5-7 years Aug. 15 for drug sale activities in Fillmore County.
On Aug. 25, Kues was sentenced by Fillmore County District Court Judge Vicky L. Johnson to not less than six years nor more than 10 years with the Nebraska Department of Corrections for the class 2 felony charge of unlawful distribution of an exceptionally hazardous drug.
Kues was also sentenced to a one-year jail term for attempted failure to affix a drug tax stamp. She was given 203 days credit for time served. Both sentences will run concurrent.
The defendant was also ordered to pay $610.39 in court costs, along with any added transportation costs. Johnson also noted Kues has a pending sentencing in Lancaster County.
Prior to sentencing, Johnson determined Kues was not a fit candidate for parole. She also noted her lengthy list of prior convictions.
On Aug. 15, Kues accepted a plea agreement with the Fillmore County Attorney’s Office and pleaded guilty to the two counts in Fillmore County.
According to court records, Kues sold methamphetamine to a R.A.P. Confidential Informant last year in the parking lot of Corner Stop in Geneva. Habitual criminal charges were dropped in the plea agreement. A DNA sample was also ordered.
Also on Aug. 25, Lee was sentenced by Johnson to not less than three years nor more than five years with the Nebraska Department of Corrections for the class 2 felony charges of unlawful distribution of an exceptionally hazardous drug.
Both sentences were ordered to run concurrent. Lee was given credit for six days served. The defendant was also ordered to pay $209.55 in court costs, plus any additional transportation costs, a $10 offender assessment and was to provide a DNA sample.
Prior to sentencing, Johnson determined Lee was not a fit candidate for probation.
A third class 2 felony count was dismissed as a result of an earlier plea agreement.
According to court documents, Lee sold a gram of methamphetamine Jan. 22, 2016, to a R.A.P. confidential informant in the parking lot of Corner Stop in Geneva.
On Feb. 8, 2016, Lee sold a gram of heroin to a R.A.P. confidential informant at the same parking lot.
Court records indicate Lee told the C.I. she had sold 10 eight balls of heroin in the past week.
