Deshler man sentenced to work ethic camp – trial set in sex assault case
District Judge Vicky Johnson sentenced a Deshler man to the McCook Work Ethic Camp for attempted burglary Thursday, Sept. 9. Christopher A. Loupin, 19, is expected to complete the program as part of a 30-month probation sentence.
“You have a significant problem with doing the right thing when you’ve been drinking,” Judge Johnson told Loupin upon handing down the sentence. Probation pre-sentence investigations indicate Loupin is considered a high risk to re-offend. “You have probably reached the end of your time when a judge will give you any slack,” the judge added.
Loupin remained mute at the sentencing. He was found guilty in June and was scheduled for sentencing in August, but his attorney, Joseph Murray, requested a continuance to give the young man time to complete a 30-day jail sentence in Clay County for MIP and face a second MIP charge in Lancaster County.
He is accused of attempted burglary of the Grandpa’s Crossing restaurant in Deshler in January 2010.
He was placed into custody Thursday to await transportation to McCook Monday. Loupin must also complete 50 hours of community service and pay $145 in costs.
Jesus Rios, 41, a former worker at Reinke Manufacturing, was sentenced to 30 months of probation for theft, a class four felony. Rios is accused of stealing copper and welding cable from Reinke’s in May.
Judge Vicky Johnson noted that Rios had already made restitution in the amount of $5,542.05 and that he had no prior criminal activity, “not even a speeding ticket,” she said.
He was also responsible for $164.44 in costs.
Eddie R. Kibbee, 45, Newton, Iowa, appeared in district court to set a trial date in his case which will be in January, 2011. Kibbee is accused of forcible sexual assault and intentionally committing child abuse in August 2009, while he was living in Deshler. He is also facing a separate sexual assault charge in Nuckolls County.
Kibbee is represented by Jerry Soucie, an attorney with the Nebraska Commission Public Advocacy Office. The Nebraska Attorney General’s Office is prosecuting the case. Thursday, attorney Sandra Allen represented the office in district court.
Timothy Brungardt, 20, Byron, entered “no contest” pleas to three separate charges Thursday after reaching agreements with prosecutors. His sentencing is set for Nov. 16 at 9:45 a.m. The Byron man faces two counts of burglary, both class 3 felonies and one count of attempted criminal mischief, a class 1 misdemeanor.
Lance Powers, 21, Hebron was charged with felony burglary after being arrested Sept. 3. He is alleged to have acted with Timothy Brungardt and broken into and stolen merchandise from Tillie’s Bar and Grill in Byron on July 15 or 16.
Powers is also facing charges in Jefferson County including felony delivery or intent to deliver a controlled substance; the procuring or selling of alcohol to a minor; obstructing a peace officer; and possession of marijuana one ounce or less and is scheduled for a preliminary hearing Oct. 4.
