Five Sentencings Made at February District Court
Five people faced sentencing last Thursday, Feb. 5, in the Thayer County district court room.
Judge Vicki Johnson sentenced Austin Virus, 26, to 180 days in jail with credit for 104 days served for one count of strangulation, a class four felony. The Hebron man also received a 90-day jail sentence for one count of domestic assault, a class one misdemeanor. Both sentencings were to run concurrently to each other. The sentencings and court costs were deemed satisfied. Virus was arrested after getting into a physical dispute with his domestic partner at the time.
Brenda Williams, 50, was sentenced to twelve months probation for theft by shoplifting, a class one misdemeanor. She is charged with stealing from Bruning Food Mart. She has previous charges of theft by shoplifting from York County in August 2013, Douglas County in June 2004 and Lancaster County on May 2000.
Timothy Brungardt, 24, was unsatisfactorily discharged from his 2010 probation sentence. Brungardt was sentenced to 36 months of probation on Nov. 16, 2010, for the burglary of C & M Supply Inc. in Deshler. In July 2014, a motion was filed to revoke his probation for failing to appear for a Sept. 2014 hearing, failing to report for drug and alcohol testing on 11 occasions, testing positive for marijuana on Nov. 4, 2013, having no proof of AA/MA attendance, failing to appear for moral reconation therapy in June 2014, not obtaining a GED within six months and having no proof of completing the Crime Victim and Accountability Class as of Nov. 1, 2012.
Nickalas Lutt, 23, was sentenced to 30 months probation for a theft charge, a class three felony. Lutt was arrested after he and another man, Gary Little III, broke into cars in Hebron in August 2014 and stole several items including a laptop and pistol.
Kyle Wolford, 26, pled no contest to assault in the third degree, a class one misdemeanor, and was sentenced to 350 days in jail with 187 days credit of time served. The sentence and court costs were deemed satisfied. In August 2014, officers arrested Wolford for causing bodily injury to a man at the Deshler Bar over a $30 ring. Wolford was arrested while awaiting sentencing on a previous charge.
The next district court hearing will be held March 5.
